Mountain Blue Orchards (MBO) announced "a landmark legal victory in the Intermediate People's Court of Kunming, Yunnan Province, China. This ruling marks the first successful case in China for the protection of Blueberry Plant Breeders’ Rights (PBR). The court ruled in favor of MBO in litigation against an unlicensed nursery for the illegal reproduction, propagation, and sale of ‘Ridley 1602’ – Eureka Sunrise (L25). This decision sets a powerful precedent, sending a clear message that the abuse of protected plant varieties must stop.
The Australian breeder also stated that "MBO remains steadfast in protecting innovation in the blueberry industry, ensuring that the rights of breeders are respected. We extend our gratitude to all of those involved in achieving this important outcome. We are committed to continuing our efforts to defend against illegal propagation and uphold the integrity of the industry."
